The following bills affecting HOAs were approved in 2018 will result in changes to the law:
AB 1943 (Waldron). Manufactured housing: foundation systems: installation: common interest developments.
Would provide that a modular or mobile homeowner, who owns a separate interest within a common interest development, is deemed to have complied with building permit requirements, to install the home on a foundation system.

Would require monthly review of the association’s financial statements, including the check register, general ledger, and assessment receivable reports. Would require the association to maintain a fidelity bond, and would prohibit the electronic transfer of funds.

Would make non-substantive changes to Code of Civil Procedure 1281.2 regarding arbitration agreements.
Read more »SB 1016 (Allen). Common interest developments: EV-dedicated TOU meters.
Would provide that any provision of the governing documents that effectively prohibits or restricts the installation or use of an electric vehicle charging station within an owner’s unit, or an EV-dedicated TOU meter, is void and unenforceable.

Would exempt homeowners of vacation ownerships and timeshares from the requirement to annually provide the association with a mailing address.
